LDN Calling – Terms and Conditions – UK


1. Contest Details

Activision Blizzard UK Ltd (the “Promoter”) is running a contest, “LDN Calling”, on https://www.amo.gd/mw3ldn (the “Microsite”) (the “Contest”). The opening date of the Contest is 26 October 2023, and the closing time and date for receipt of entries is at 23:59 local time in the United Kingdom on 31 October 2023 (the “Contest Period”). Entries submitted after this time will not be considered, even if it is still possible to submit entries via the Microsite.

The Contest will be administered by Universal International Music BV of s’Gravelandseweg 80, (1217 EW) Hilversum, Netherlands d/b/a Universal Music Group for Brands (“Universal”). All matters relating to these terms and conditions should be directed to Universal at LDNcalling@umusic.com.

2. Restrictions

This Contest is only open to residents of the United Kingdom (excluding Northern Ireland) aged eighteen (18) and over. Directors, officers and employees of the Promoter and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies involved in the Contest, and immediate family members and those living in the same household of such persons (whether legally related or not) are not eligible to enter or win any prizes in this Contest. Subject to all applicable laws and regulations.

3. Rules to participate

No purchase of any goods or services is necessary to be eligible for entry into this Contest.

The Contest will be run via the Microsite.

During the Contest Period, entrants must successfully complete one (1) of the three (3) missions on the Microsite and, once completed, submit their name and email address and (optionally) social media handle(s) via the form displayed after completion of the mission (“Entry Form”).

Entrants will receive one (1) entry to the Contest for each of the missions that they complete during the Contest Period (provided that they submit their name and email address via the relevant Entry Form). Entrants can enter the Contest a maximum of three (3) times during the Contest Period (i.e. by completing each of the three (3) missions). Multiple entries by completing the same mission more than once will not be counted.

Submissions received from any person, account or email address in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void.

In the event that an entrant submits their social media handle(s) at the time of entering the Contest, the entrant grants the Promoter the right to use, publish/re-publish, display and/or embed social media posts of the entrant relating to the Contest (“Relevant Posts”) on the Microsite – and, for that purpose, grants the Promoter a non-exclusive, irrevocable, royalty-free, worldwide, perpetual licence (with a right to sub-license) to use, publish/re-publish, display and/or embed the Relevant Posts on the Microsite. Furthermore, the entrant waives any moral rights in the Relevant Posts to which the entrant is now or may at any future time be entitled under Chapter IV of the Copyright Designs and Patents Act 1988 or any similar provisions of law in any jurisdiction, including (but without limitation) the right to be identified, the right of integrity and the right against false attribution, and agrees not to institute, support, maintain or permit any action or claim to the effect that any treatment, exploitation or use of such Relevant Posts or other materials infringes the entrant’s moral rights.

4. Prize(s)

Twenty-five (25) winners will each receive two (2) tickets (i.e. one (1) for the entrant and one (1) for a guest of the entrant (a “Guest”)) to a Call of Duty®: Modern Warfare® III launch event (the “Event”) (the “Prize”/“Prizes”). The Event will take place at a location and time that will be revealed by completing the missions (which, in any case, will be confirmed by the Promoter to each winner when awarding the Prize), or such other location and time as may be notified by to the winners by the Promoter. All attendees of the Event must be 18 or older and provide valid photo ID at the entry.

The winners will be randomly selected by the Promoter, or a third party on their behalf, from all valid entries by a computer process that produces verifiably random results. The judges’ decision is final. No correspondence will be entered into.

Winners will be contacted via email by Promoter’s representatives by email once the Contest has closed.

If a winner does not respond after a period of time deemed reasonable by the Promoter, the Prize for that winner shall be forfeited and the Promoter will be entitled to select an alternative winner from among the eligible entries.

If proof of identity, age or residence is requested of the winner or their Guest, and if satisfactory proof is not received within a period of time deemed reasonable by the Promoter, the Prize shall be forefeited and Promoter reserves the rights to choose another winner from among the eligible entries. winners may be required to verify the identity and age of their Guest.

Promoter will be responsible for delivering the Prize to the winners, but winners will be responsible for all other costs associated with the Prize, including but not limited to any costs associating with travelling to and attending the event. Each winner will be required to provide Promoter with personal data necessary to arrange delivery of the Prize, and may be required to verify their name, age and place of residence.

The Prizes carry no cash value, are non-transferable and may not be substituted by the Winners. If due to circumstances beyond the control of Promoter, Promoter is unable to provide the Prize, Promoter reserves the right to award a substitute prize of equal value. All Prizes are subject to the terms and conditions of entry to the Event and the venue. Any taxes due on the Prizes will be paid by the winner save for any tax which is required to be paid by Promoter under the applicable laws.

Winners acknowledge and agree that the Event will be attended by various other individuals that have not entered this Contest.

5. Results

A list of winners will be available for four (4) weeks following the day of the selection of the winners. This list can be obtained by writing to LDNcalling@umusic.com with the title ‘LDN Calling – Winners list’.

6. Data protection

By participating in this Contest, entrants hereby acknowledge that Activision Blizzard UK Ltd or their representatives or agents may collect, share, and otherwise use their personal data in compliance with applicable laws and regulations. 7. General Conditions

Any entry, which does not comply with the rules, may be deemed invalid at the sole discretion of Promoter. Neither Promoter nor Universal is responsible for technical, hardware or software malfunctions, misdirected entries, lost or unavailable network connections, failed, incorrect, garbled, delayed electronic or other communications or other technical problems related to mobile entries. Proof of sending will not be deemed to be proof of delivery.

Any entrant who enters or attempts to enter the Contest in a manner, which in Promoter’s determination, is contrary to these rules or by its nature is fraudulent or unjust to other entrants including without limitation tampering with the operation of the Contest, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Promoter and/or any of its agents or representatives, or who submits an illegible or incomplete entry may be rejected from the Contest at Promoter’s sole discretion. Furthermore, the Promoter reserves the right to disqualify any entrant or entry, or cancel/void a Prize already granted, if, in its reasonable opinion, the Promoter believes that the entrant (or their Guest) or entry may bring the Promoter, its brand, the Contest or the Event into disrepute, or may otherwise put those at the Event at risk of any harm.

Entrants agree that their names may be used to announce the winners on Promoter’s websites and be included on the winners list as mentioned in section 5 above.

By entering this Contest, entrants agree to be bound by these Terms and Conditions and by any other requirements set out in the promotional material – and warrants and represents that any relevant Guest also agrees the same. Promoter reserves the right to modify, cancel, terminate or suspend the Contest in whole or in part, at its sole discretion, if it believes the Contest is not capable of being conducted as specified in these rules or in the event of a virus, a computer bug or unauthorised human intervention or any other cause that is beyond reasonable control of Promoter that could corrupt or affect the administration, security, impartiality or normal course of the Contest.

The Promoter, its agents and commercial partners (including but not limited to Universal) exclude to the fullest extent permitted by law any liability associated with this Contest, including but not limited to (a) any loss or damage arising from or in connection with the Website, the Contest or with the acceptance or possession of the Prize / attendance at the Event (other than those warranties or conditions implied by statute and which cannot be excluded); (b) the accuracy or otherwise of any description or illustration of the Prize; (c) any loss, damage, non-availability or late receipt of the Prize or any communication associated with this Contest; and (d) any fees, charges, taxes or other costs that may be payable in connection with the Prize. The Promoter and Universal further disclaim liability for any injury or damage suffered by the entrant or the entrant’s guest relating to or resulting from participation in the Contest or attendance at the Event, in or downloading any materials in connection with the Contest. Neither the Promoter nor Universal will be liable for failure or delay in delivery or performance of their obligations under these Terms and Conditions in the event of any unforeseen cause beyond its control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure. Neither the Promoter nor Universal is responsible for any third party acts or omissions.

These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established hereunder.
